Continuing from the last message, the difficulty is in appropriately deciding the achievability of a goal. How does one arrive at a shared resolution of all parties' interests. The answer is actually quite simplistic. Intuitively, there must be an appreciation of what interests parties hold and then a decision needs to be made as to goal setting within this model. Goals on their own are irrelevant. The only situation that works is to integrate the reality of a likely occurance such as a judgment of the court with the perspective of the other parties as to what concern they have that an imposed settlement will be less helpful to them than one constructed through mutuality of perspective and eventually a consensus that takes everything into consideration.
